New Bill Would Punish Schools & Doctors for Not Outing Trans Minors in US State Of Idaho


Idaho lawmakers have passed a sweeping bill that would require teachers, healthcare providers and other professionals to inform parents within 72 hours if a minor expresses a transgender identity or asks for changes such as a different name, pronouns or access to spaces that align with their gender identity.

The legislation, House Bill 822, would allow parents to sue individuals and institutions that fail to disclose that information. According to Idaho Capital Sun, the bill treats non-disclosure as effectively helping a child’s social transition and could expose schools, clinics and professionals to civil penalties of up to US$100,000.

The bill is co-sponsored in the Senate by Republican Senator Ben Toews, who has argued the measure would close what he describes as a loophole in Idaho’s existing transgender laws by targeting social transition. Idaho Capital Sun reported that Toews referred to social transition as “the process by which vulnerable children are led into the pipeline.”

Opponents say the proposal could dramatically reshape how schools and healthcare providers interact with LGBTQ+ young people, forcing staff to choose between supporting vulnerable students and avoiding legal risk. If enacted, the law would have broad consequences for privacy, trust and access to care. This is an inference based on the bill’s reporting and structure.

The measure is the latest in a broader wave of anti-LGBTQ+ legislation moving through Idaho. In a separate move, Governor Brad Little signed House Bill 752 into law on 31 March 2026, criminalising transgender people for using bathrooms or changing rooms aligned with their gender identity in many public and private settings.
